What is a Bond Forfeiture?
A bond forfeiture happens when a defendant fails to appear in court as required. This is a serious situation where the judge demands the surety or bail bondsman pay the full bond amount to the court in cash within a set timeframe. Bond forfeitures are considered the “worst-case scenario” for all parties involved in the bond agreement because they create significant financial and legal consequences. If the defendant can be quickly returned to court, the judge may set aside the forfeiture, mitigating some of the damages. However, if the defendant evades capture or hides, a bail bond company will typically employ a bail enforcer, commonly known as a bounty hunter, to locate and surrender the defendant to the proper jurisdiction.
